The following Terms and Conditions of use apply to all users of the domains ohiristudio.com and their subdomains (hereinafter referred to as ‘site’ or ‘website’). Until the right of property in the products passes, OHIRI shall have authority to retake, sell or otherwise deal with and/or dispose of all or any part of the goods.
We remind you that the discount of bills or any other remittance creating a payment bond does not constitute a payment in itself.
Upon delivery of goods, the risks pertaining to the goods are automatically transferred to buyers. The purchaser thus undertakes to apply for an insurance contract guaranteeing risks of loss, damage and theft of the goods.

By placing an order on the site, you certify that you are purchasing products for your own personal use and not for resale and that you accept our general terms and conditions. In case of Force Majeure, OHIRI’s obligations will be suspended. The contract between you and OHIRI can, in such cases, be partially or fully terminated by yourself or by OHIRI.
Cases of Force Majeure (or fortuitous events) are defined as events beyond the control of the parties that could not reasonably be considered as foreseeable by them and that they could not reasonably have avoided or mastered, to the extent that their occurrence completely prevents the execution of their obligations. The following shall be considered as cases of Force Majeure: war, civil war, revolution, riot, governmental measures, strike, flood, epidemics, failures in the supply of raw materials, failure of electricity, telephone or internet services, natural disasters, or similar events.
Under such circumstances, OHIRI will attempt to resolve all issues in a timely manner.
These Terms and Conditions of use are governed and built-in accordance with French law without regard to principles of conflicts of laws. The courts of Lille will have exclusive jurisdiction for any dispute under this agreement. The laws of your country may differ from France ones and there may be additional legal requirements to use this website. OHIRI collects some protected personal information (e.g. name, postal addresses, telephone number(s), email address etc.) from visitors to the website who register their information or who use the online store. We want all customers to receive quality goods. We put in extra effort to keep each Akan bead and all handcrafted jewellery close to their original shape. However, due to the handcrafted jewellery making process, minor differences may occur on their colours or shapes.
We also put in extra effort to display the colours of our products as accurately as possible. We cannot guarantee that colours on the site will be true to life. The colour reproduction may partly depend on the colour settings of your computer and monitor.
To the extent permitted by French law, OHIRI cannot be held accountable for any direct or indirect losses linked to dereliction of duty, breach of contract, negligence or in any other way.
HOW TO ORDER / PLACING AN ORDER
Any order made on the site is assumed done by the account holder. You are encouraged to verify that you are logged in to the right account before purchase. Under French law, an online order is validated only when the customer has made a double-click: one to place the order and the other one to confirm it. Confirmation shall be deemed a signature and acceptance of transactions.
It is your responsibility to keep your account password secure. In the event of any breach of security or unauthorised use of your account, please contact us immediately by emailing email@example.com. OHIRI cannot be held liable for any of your losses due to any unauthorised use of your account.
We do not always have items in stock. In such case, your order can be made just for you and delivered within 4 weeks. If your item is required urgently, please email us at firstname.lastname@example.org and we will figure out the best solution.
As soon as your order is registered in our checkout system, you should receive an email confirming that OHIRI has received your order. If you did not receive this email in your inbox, please check your junk folder.
Once the order has been processed, you will receive a second email confirming that you order is completed and when it will be dispatched from our workshop.
All merchandise is sold on a first pay basis and is subject to availability. Please note that items in your shopping cart are not secure until order payment is successfully processed, and may be purchased by other customers.
We reserve the right to limit the quantities of OHIRI products that we supply, and/or to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a client with whom there is a dispute concerning the payment of a previous order.

IN STOCK. You can purchase the item right away.
PRE-ORDER. You order an item which has not yet been released. The pre-order guarantees you immediate shipment on release. You will be notified as soon as the product will become available.
BACK SOON. You are encouraged to register your email address as requested and you will be notified as soon as the item will become available.
SOLD OUT. The item is no longer available.
OHIRI does not guarantee that all products purchased on the web shop are in stock at the time of your order. In the event that a product is unavailable, OHIRI will contact you shortly by phone or by e-mail. We will give you the option of cancelling your order or replacing it with a new order. In case of order cancellation, you will receive your refund within a maximum of 30 days. Any refund will automatically be issued to the card, or the PayPal account used to make the original purchase.
OHIRI reserves the right to update or modify the products list at any time and without notifying users.
All prices stated on our website are in Euros (EUR) by default. During check-out, payments will still be processed in EUR.
Although OHIRI strives to display the correct texts, images and pricing on the site and web shop, errors may occur. If you have been charged the wrong amount in the web shop, OHIRI will give you the option of placing a new order with the correct price or cancelling your order. OHIRI, however, reserves the right to cancel any order prior to dispatch if we find that the price is incorrect. In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled.
When placing an order at the web shop you guarantee that information regarding your payment is correct and valid. The prices listed do not include shipment costs. See section on shipment and delivery for further information.
For International customers purchasing from other countries outside of France, please note that any taxes or customs fees in regard to your purchase are to be held responsible by the customer.

TERMS OF PAYMENT
Unless otherwise stipulated, all invoices are to be paid to the company head office according to the specific conditions mentioned on our order confirmation.
Orders will automatically be cancelled if payment is not completed within 24 hours upon completion of order. Following which, order will not be held or reserved for you, extension of time frame for payment will not be tend too. A new order must be made upon automatic cancellation of order.
Payment can be made by Debit/Credit Card or PayPal.
To make payment via PayPal, simply select the PayPal option when checking out. You will automatically be directed to the PayPal website. If you were not properly directed during, check out, you can also make payment directly to email@example.com or on PayPal’s website.
All customers paying by card are subject to validation checks. Any customer guarantees to be fully authorized to use the card used. OHIRI reserves the right to delay any order if fraud is suspected. For security reasons, we do not store any payment information in our database.
The credit card used must be in your own name. All card owners are submitted to validation, control, and approval of the credit card issuer. Should your credit card issuer refuse payment, OHIRI cannot be held responsible for any delays or failed deliveries. Should the credit card approval and validation fall though entirely, OHIRI reserves the right to annul the order.
You may purchase products on ohiristudio.com for personal use only and not for resale. By placing an order on the site, you certify that you are purchasing products for your own personal use and not for resale and that you accept our general terms and conditions of use. We reserve the right to refuse orders for any reason without explanation.
These Terms constitutes a part of the OHIRI General Terms and Conditions. These Pre-Order Terms and Conditions (“Terms”) govern the placing of pre-orders (“Pre-Order”) with Ohiri ILLC. Please read these Terms carefully before submitting your Pre-Order of any OHIRI Products. By submitting your Pre-Order, you agree to be legally bound by these terms.
Pre-released orders (“Pre-orders”) are orders for products (“Products”) that are not yet available for general sale from OHIRI
When placing a Pre-Order for OHIRI Products, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. OHIRI shall have no responsibility or liability for inaccurate information or information that later becomes outdated and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your product being shipped by sending an e-mail to firstname.lastname@example.org
You acknowledge and agree that OHIRI may decline or delay reservations to avoid oversubscription or as it deems appropriate, provided that we will make efforts to inform you within two (2) weeks of our receipt of your Pre-Order, and that you will be entitled to a full refund of the purchase Price.
You will be charged the full Price of the Products at the time of placing the Pre-Order. If OHIRI is unable to commence shipping the Products on or before the one-year anniversary of your placing the Pre-Order, OHIRI shall process a full refund to you. Your placing of a pre¬order constitutes your express agreement to OHIRI of charging the full Price of the Products at such time.
This is how the pre-order process works:
1- You order and pay now.
2- Within a few minutes, you will receive an order confirmation email and a payment confirmation email.
3- We will send you an estimated delivery date a few weeks later once we receive an update from the factory.
4- Your order status will change once it is at our warehouse and preparing for shipment
5- Finally, once your order leaves the warehouse, you will receive an email with a track and trace link. The delivery time from this moment should only take between 3 – 10 days.
Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD) is only an estimate, is subject to change, and OHIRI does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, OHIRI is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your reservation as provided for in Section CANCELLATION below.
The purchase price ("Price") does not include taxes and other government charges, which are your responsibility. If the Price drops after you have pre-ordered, we will refund you the difference. If the Price goes up, your order is secure at the low Price. The Pre-Order Price is valid from the moment you place the Pre-Order right up to 10 days after you receive the item. You or OHIRI may cancel this reservation by terminating the Pre-Order at any time for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If OHIRI cancels your reservation you will receive a full refund of the purchase Price without interest (and you will not pay any processing fee).
LIMITATION OF LIABILITY
Under no circumstances will OHIRI be held liable for any incidental, special or consequential damages arising out or related to this agreement. In the event OHIRI is held liable for any damages arising out or related to this agreement, your sole and exclusive remedy will be the full refund of your purchase price without interest.
TERMS AND CONDITIONS OF SALE
The purchase of the Products is subject to additional terms and conditions provided by OHIRI including in respect of any software included in the Products or intellectual property embodied in the Products or data collected by the Products.
OHIRI disclaims any warranties, express or implied, with respect to the prototype product displayed by OHIRI whether before or after you have placed the pre-order. You understand and agree that the product, its design and technical features are currently under development and that the product that may be available for purchase by you may be materially differently from the prototype product. If for any reason you are unhappy with the final version of the product, your sole and exclusive remedy will be to cancel your pre-order as described in section 6 above.
The delivery dates and delays are specified by OHIRI as accurately as possible but are subject to availability of supplies, and transport of the latter. OHIRI cannot be held responsible for late delivery resulting from Force Majeure and any circumstances beyond control. The occurrence of such events cannot give rise to any payment of compensation on behalf of OHIRI.
Delays relative to the initially stated terms of delivery, which are given for information only, shall not entitle clients to cancel the orders they have placed with us and that we have accepted.
Deliveries are made to the benefit of the purchaser and associated risks are transferred to the latter in accordance with the Incoterm held by both OHIRI and purchaser at the time of placement of the first order.
Deliveries are made carriage paid. Risks for the products sold by OHIRI are transferred upon handing over of the products to carriers.
For any order, please allow up to twelve (12) business days (not including weekends or holidays) for us to process your order. Processing time is required so that we can review your order information and prepare your package for shipping.
All shipping services that we used provide tracking and full insurance. Once your order is shipped, an email will be sent out with a tracking number for your package. Please allow at least one business day after your order is shipped for the tracking information. If you do not receive tracking, and the expected delivery date has passed, please contact us at firstname.lastname@example.org so that we can assist you further.
To ensure safe delivery of your purchases, OHIRI always uses Express Post with signature on delivery. Please ensure there will be someone to sign for your package when it arrives or that the shipping service collection card can be left in a safe place. OHIRI cannot be held responsible if incorrect details are given, or if your postal slip is stolen. You are encouraged to nominate a current address that is a trusted residence or workplace. Please note that we are unable to ship to P.O. Boxes.
If a package is returned to France because the buyer did not claim the package, OHIRI does not send replacements.
In the rare occurrence that your order is damaged or lost in the mailing process, we will take each case into deliberation and proceed further with investigation. In such case, please contact us at email@example.com.
Domestics orders (France) are shipped via DHL France or French Postal Services. Domestic orders typically arrive within 2 to 4 business days and will be charged at a flat rate of 10 Euros.
International orders are shipped through FedEx or DHL. International shipping delivery times and rates are dependent on which carrier service chosen.
Be sure that OHIRI do the most profitable choice for you by all means necessary.
Any taxes or custom fees as deemed by your country’s legal regulations are to be held responsible by the customer. In the event that an order is returned to us due to incorrect delivery address provided by the customer, or if left unclaimed, the full cost of redelivery will have to be borne by the customer.
Please note that shipment time for special orders may be longer.

Goods are classified as faulty if they are received damaged, non-conformed or if there is a manufacturing fault. Please note that items that are damaged as a result of normal wear and tear (including items that have been bent out of shape, twisted, oxidized or on which the plating is fading) are not considered to be faulty.
Products shall be checked by customers upon delivery. The purchaser has eight (8) days from delivery to express any claims regarding such conspicuous defect by recorded delivery letter with return receipt. The purchaser is responsible for providing all evidence relevant to the matter.
Our customer services will take each case into deliberation and proceed further with investigation.
No action shall be brought for non-conformity of any products within eight (8) days upon delivery.
If you wish to exchange a faulty item, please write an email with the specific details to email@example.com. Any purchased goods shall not be returned without our prior express agreement in writing, to be requested among other means by facsimile or by electronic mail.
OHIRI cannot be held liable for any other damage, without limitation, resulting from the use of one of the products purchased on ohiristudio.com.
If you wish to exchange an item, please write an email with the specific details to firstname.lastname@example.org. Any purchased goods shall not be returned without our prior express agreement in writing, to be requested among other means by facsimile or by electronic mail.
In accordance with the French legislation an item can be returned within 14 days. This is from the day that the item was received. The item returned must be unused, unworn, unaltered, undamaged and in the original condition, which includes tags and original packaging (any boxes, bags, and other packaging materials). All goods will be inspected on return and any item in unsuitable condition will be sent back to you.
Any return costs shall be borne by us only for missing goods or conspicuous defects as ascertained by ourselves or by our authorised agent.
Please note that the items are your responsibility until they reach the workshop and please ensure you package your return to prevent any damage to the items or boxes. OHIRI is not responsible for any items that are returned in error or lost in the mail, which is why it is recommended to use an ensured postal service. If your package is not successfully delivered and is sent back to OHIRI by the courier, we will contact you to provide the option of reshipment or a refund of the merchandise. The original shipping fee is not refundable.
Once we receive your returned parcel, we will inspect and process the goods within four (4) working days to ensure you receive your refund as quickly as possible. Any refund will automatically be issued to the card or the PayPal account used to make the original purchase.
Please note that special orders and sales cannot be returned or exchanged.
If your delivery is not identical to your order (wrong product) due to our oversight, please contact us with your order number as well as the return information. Postage incurred will be borne by us. Returns must be notified of, confirmed and returned within 10 days (domestic orders) 20 days (international orders) from order fulfilment.
Due to hygiene reasons, we are unable to accept returns of pierced jewellery or lip jewellery under any circumstances.
We are happy to exchange items which are in the wrong size where possible and if they are in stock (discontinued designs cannot be exchanged). The first exchange is free. You must pay for the postage. Please post your item to the address below, well packaged in its original packaging and include a prepaid express postbag with the signature on delivery option. Email us at email@example.com to notify us that you require an exchange and the size required. Please also include a note in your package with the desired size.
Some rings may not be resizable. Subsequent size exchanges will incur up from 80€ to 100€. Resized rings cannot be returned, and plated rings cannot be resized.
